NYS moves to kick Charter Communications out of state

The action by the Public Service Commission follows months of disagreements over the company's progress in meeting goals set by regulators in 2016 as a condition of their merger approval- especially an expansion of broadband to rural areas. The company must provide uninterrupted service while the state transitions to a new service provider, the commission said.

The New York State Public Service Commission on Friday revoked its approval of the 2016 merger agreement between Charter Communications Inc. and Time Warner Cable Inc. because Charter, doing business as Spectrum, has, according to PSC - through word and deed - "made clear that it has no intention of providing the public benefits upon which the commission's earlier approval was conditioned".

Since then, NY says Spectrum has fallen short in almost every aspect of the deal, failing to meet the incremental deadlines and obligations for several rural communities, they have engaged in unsafe field practices, and they have attempted to obfuscate their shortcomings by blaming other companies. ". The commission has previously directed Charter to cease its misleading campaign and has referred the matter to the NY attorney general for appropriate action".

But when it provided its next update in December, commission officials said Charter did not deserve credit for more than 18,000 households it said it had connected, in part because many of them appeared to be located in New York City and not a hard-to-reach, less densely populated area. The company is required to deliver broadband speed upgrades of 100 megabits per second by the end of next year, and reach 145,000 underservered or unserved homes and businesses by 2020. The regulatory authority shall revoke the authorization for the merger of Charter Communications, Inc. with Time Warner Cable, Inc.

Charter said in a statement that its Spectrum internet brand "has extended the reach of our advanced broadband network to more than 86,000 NY homes and businesses since our merger agreement" with the Public Service Commission, and is working to deliver broadband to more New Yorkers.

Charter will undoubtedly do everything in its power to block this move, so don't expect Spectrum to suddenly vanish from NY in two months, but perhaps this will at least lead to some positive changes.

The commission ordered Charter to pay the state $1 million for missing the June milestone; that brings the total assessed by the PSC to $3 million.

In addition, the Commission has directed its counsel to bring an enforcement action in State Supreme Court to seek additional penalties.

"Since that time, however, not only has Charter's performance been wholly deficient and its behavior before the Commission contrary to the laws of NY state and regulations of the Commission, but it has also repeatedly claimed not to be bound by the terms of the Commission's approval".

Spectrum - formerly known as Charter - is one of the most popular cable television and Internet access providers in the United States.

Charter says it remains focused on expanding broadband and said "rhetoric often becomes politically charged" in election years. During the transition process, Charter must continue to comply with all local franchises it holds in NY state and all obligations under the Public Service Law and the commission regulations.
