Poland's Government Forcing Supreme Court Justices To Step Down

Mucha, speaking to reporters after a meeting in the matter attended among others by Poland's President Andrzej Duda and Gersdorf herself, said that during the meeting Duda clearly confirmed that the new Supreme Court legislation was binding law, also with regard to judicial retirements.

But Gersdorf, who is 65, insisted Tuesday that she can not be ousted before the end of her term, which runs until 2020 and is guaranteed by the Polish Constitution, The Associated Press reported.

"My term as the Supreme Court head is being brutally cut, even though it is written into the constitution", Gersdorf told law students during a lecture she gave before the presidential aide said she wouldn't be allowed to continue on the court.

Gersdorf, 65, has refused to comply with the law that took effect on Tuesday at midnight and brings down the retirement age for Supreme Court judges from 70 to 65. "To a large extent, the independence of Poland's constitutional court has been destroyed".

Brussels says Poland's judiciary reforms, including changes to the rules governing the Supreme Court, subvert the bloc's democratic standards.

However, Gersdorf plans to go to work as usual on Wednesday, a court spokesman said soon after Duda's announcement. Its justices also rule on the validity of elections. Of the 73 Supreme Court judges, 27 are 65 or over - though 11 refused to apply to continue their work.

"What if I have a court case against someone from PiS and they will be able to influence judges".

But he noted that shifting from coal to natural gas was particularly challenging for Poland because the latter could only be sourced from Russian Federation, "so all efforts to increase our use of gas would have destabilized our security", Morawiecki said.

Escoto explained that Honeycutt had been playing basketball in Russian Federation and was struggling to adapt to life there. Once inside they found Honeycutt completely unresponsive with what appeared to be self-inflicted gunshot wounds.

Demonstrations in support of Gersdorf and other defiant judges are due to take place on Tuesday and Wednesday around the court's offices in Warsaw.

After staging protests on Tuesday outside the Supreme Court, Polish pro-democracy activists have vowed to hold more rallies around the country on Wednesday.

On Monday the European Union launched legal action against Poland's right-wing government, saying the law undermined judicial independence. Some accused his government of backtracking on Poland's democratic gains, saying the new laws put the courts under political control.

Hundreds of people demonstrate to support the Polish Supreme Court Justice president in front of the Supreme Court building in Warsaw.

Poland faces the threat of losing its voting rights in the European Union under a procedure launched late previous year over judiciary reforms. The newspaper reported that Jaroslaw Kaczynski, the leader of Poland's ruling party, said Gersdorf is "doomed to fail miserably".

Amnesty International last month warned that Polish citizens' human rights were at risk from "systematic erosion of guarantees for an independent judiciary" and urged the Polish government and parliament to amend the laws in question.

Unless Poland responds sufficiently to the EU's challenges, they could risk losing voting rights and funding.

The European Commission, which polices compliance with EU laws, opened an infringement procedure Monday against Poland over the Supreme Court law.
