Kenya's top prosecutor has ordered a probe into the collapse of the dam on Wednesday night, as questions mount over the quality of construction of the private reservoir on a vast farming estate.

The Kenyan Red Cross says it has rescued about 40 people so far. My neighbour was killed when the water smashed through the wall of his house.

The region is dotted with irrigation reservoirs built in the last two decades to meet the demands of the rapidly expanding agricultural sector, the biggest foreign exchange earner for East Africa's largest economy and a major source of jobs.

A government statement released earlier this week had put the number of people displaced by floods in Kenya at 222,456, a number that is likely to increase following the thousands who have been left homeless in Nakuru County.

Mr Jayakumar expressed confidence that the relationship between the farm and the villagers around it will remain firm despite the disaster wrought upon them by the weakness in the wall of the dam. He ordered all the others to be drained as a precaution.

The general manager of the farm has denied that they have done something wrong. "Just because of what happened you can't say it is illegal", he told Citizen TV in an interview on Friday.

"I thought it was rain", he said, adding he and his family and managed to seek shelter in a nearby building from the raging floodwaters. Bridges have been swept away and roads turned into rivers of mud.

The Kenya Red Cross has already made an appeal for $5 million following the heavy rains that have wreaked havoc across the country, with 11 counties been most hit by the latest spate of floods.

"But now - two months later - we are seeing the consequences of the drought-ravaged land's inability to absorb all the rain".
