Woman sues fertility doctor for using his sperm to father her

The DNA test revealed that the doctor was the woman’s mother More

Her parents, who are now divorced, were having difficulty conceiving and approached Dr Gerald E Mortimer for help.

That was until she learned the same doctor had artificially inseminated her mother with his own sperm and delivered Rowlette-his biological daughter-in May 1981, reports the Daily Beast.

Mortimer's suggestion to the hopeful couple was a procedure that inseminated a mix containing 85 percent of Fowler's semen with 15 percent from a donor.

When Rowlette got the DNA results from Ancestry.com in July and saw Mortimer's name as a likely parental match, she assumed the results were flawed. The service not only connected her genetically to a man she had never heard of, named Gerald Mortimer, it told her that Mortimer was her father.

Kelli Rowlette thought she knew who her biological father was.

"Dr Mortimer fraudulently and knowingly concealed his use of his own genetic material in the procedure", according to the complaint.

The Ashby, Fowler and Rowlette are suing Dr. Mortimer, now-retired, along with Obstetrics and Gynecology Associates of Idaho Falls, where he used to practice, for battery, fraud, intentional and negligent emotional distress, breach of contract and medical negligence, among other charges.

Yet a year ago, Rowlette, now 36, discovered through a commercial DNA test that she had a parent-child genetic match with her mother's doctor, Dr. Gerald Mortimer, according to the lawsuit.

The lawsuit also states Mortimer "cried" when the mother informed him they were moving from Idaho to Washington state. Rowlette's parents, Ashby and Fowler, say that it was agreed that Fowler's sperm would be mixed with that of a college-age donor, says the 14-page complaint. Eventually they sought professional help from Mortimer, who diagnosed Ashby with a tipped uterus and Fowler with a low sperm count and low sperm motility.

Dr Mortimer told the couple he had a donor in mind, and he performed the artificial insemination procedure three times a month throughout the summer of 1980.

Websites like Ancestry.com and 23andMe purport to give people insight into where they and their families came from through DNA testing.

Rowlette was reportedly unaware her parents had turned to artificial insemination after struggling to conceive.

"Based on what we know from what's been reported, and the knowledge of how our system works, it's possible that both biological mother and father both took the test, and that the child did as well, however without further details we can not speculate on individual cases", Melissa Garrett, a spokeswoman for Ancestry.com, wrote in an email.

Rowlette found out the truth on her own in October when she noticed Mortimer's signature on her birth certificate.

Mortimer could not immediately be reached for comment, and it's not clear whether he has an attorney.
