It is a very sad and unprecedented day for the institution that four of the senior most judges (Justice J Chelameswar, Justice Madan B Lokur, Justice Kurian Joseph and Justice Ranjan Gogoi) of the apex court felt compelled to take the issue with respect to their grievances directly to the public and in the process destroying the image of the collegial unanimity on the basis of which numerous institutional decisions are taken.

The press conference was called at Justice Chelameswar's residence here at Tughlaq Road.

He expressed hope that their actions will bring in more transparency in the administration of the Supreme Court.

The open revolt of the Supreme Court's four most senior judges is certainly unprecedented, but only time will tell whether it is a revolution or a mere storm in a teacup.

But the Centre plans to avoid intervening in the tussle, as it feels the matter raised by the four apex court judges is judiciary-specific and does not merit third party intervention.

Another issue that the judges noted in the letter and put before the media was over the Memorandum of Procedure (MoP) of appointment of the judges of the Supreme Court and High Courts.

Judge Loya was hearing the case which accused BJP Chief Amit Shah in relation to the fake encounter case but he died in December 2014.

Jasti Chelameshwar said that "We tried to persuade the CJI that certain things are not in order". On being pressed, the judges confirmed that the press meet prompted by the issues surrounding Justice Loya's mysterious death.

A seven-member delegation from the Bar Council of India (BCI) will meet the judges of the Supreme Court in a bid to resolve the controversy over assignment of cases by the Chief Justice of India.

However, the Judges declined to elaborate on the Loya case.

This raises some serious questions on the integrity of the office of the CJI. The CJI and the four judges comprise the SC collegium that selects judges for the higher judiciary. That the Supreme Court senior judges have blown the lid off is praiseworthy and it's for the nation to decide whether they need democracy and cherish its freedom or they would rather look to newer methods of governance even by losing all their democratic privileges.

The Supreme Court itself is in dock. There are mechanism in the Supreme Court to deal with and settle such crisis. "So no, it's not an internal matter for the Hon SC", Abdullah said. "It seems clear to me that there's a war going on". Rasheed has said that the developments are not only detrimental for Indian judiciary but will have vast consequences in the entire subcontinent.
