U.S. supreme court dismisses challenge to Trump travel ban

Opponents of the ban, who had persuaded the two appeals courts to block the executive order, said the court should continue to review the cases.

The court has not yet announced whether it plans to hear the other challenge to the order brought by the state of Hawaii regarding Trump's ban stopping the refugee resettlement program in the US for 120 days. The lawyer dismissed the case in a way which preserved the appeals court ruling against the ban rather than vacating it.

The justices had combined the two cases and set them for argument that was to have taken place Tuesday.

The refugee ban itself does not expire until October 24.

The challenges in both cases already have renewed their lawsuits in the lower courts, starting the legal process anew.

One of the challenges to President Donald Trump's March 6 executive order, often known as the "travel ban", came to an end at the Supreme Court today, at least for now. By putting new versions of his ban in place after old versions expire, Trump may be able to roll the dice over and over again until he finds a version that the Court will deem acceptable.

The high court's new order vacated a caustic ruling that the 4th U.S. Circuit Court of Appeals issued in May in which the court's chief judge declared that Trump's ban "drips with religious intolerance, animus and discrimination". It includes Iran, Libya, Somalia, Syria, and Yemen, Chad, North Korea, and Venezuela.

The court made clear it was not taking a position on the merits of the case.

Notably, Justice Sonia Sotomayor dissented from the Court's Monday order.

Trump's new ban restricts travelers from five of the six countries on his original list.

Unlike the other bans, it treats some countries and types of travelers, such as students or tourists, differently than others.

Hawaii, which brought the 9th Circuit challenge, warned the justices that elements of the earlier ban still could be revived, since Trump has said he wants a "much tougher version".

The 4th Circuit case was brought by the International Refugee Assistance Project, which argued that banning travel from six majority-Muslim countries violated the First Amendment's guarantee of freedom of religion.
